For Immediate Release March 05, 2013 President Obama Signs Disaster Declaration for the Navajo Nation

The President today declared a major disaster exists for the Navajo Nation and ordered Federal aid to supplement the Tribe’s efforts in the area affected by a severe freeze during the period of December 15, 2012 to January 21, 2013.

Federal funding is available to the Navajo Nation and certain private nonprofit organizations on a cost-sharing basis for emergency work and the repair or replacement of facilities damaged by the severe freeze.

Federal funding is also available on a cost-sharing basis for hazard mitigation measures for the Tribe.

W. Craig Fugate, Administrator, Federal Emergency Management Agency (FEMA), Department of Homeland Security, named Mark A. Neveau as the Federal Coordinating Officer for federal recovery operations in the affected area.

FEMA said additional designations may be made at a later date if requested by the Tribe and warranted by the results of further damage assessments.

For Immediate Release March 06, 2013 Statement by the President on Republican Filibuster of Caitlin Halligan

I am deeply disappointed that despite support from a majority of the United States Senate, a minority of Senators continues to block the nomination of Caitlin Halligan to serve on the U.S. Court of Appeals for the District of Columbia Circuit. Nearly two and a half years after being nominated, Ms. Halligan continues to wait for a simple up-or-down vote. In the past, filibusters of judicial nominations required “extraordinary circumstances,” and a Republican Senator who was part of this agreement articulated that only an ethics or qualification issue – not ideology – would qualify. Ms. Halligan has always practiced law with the highest ethical ideals, and her qualifications are beyond question. Furthermore, her career in public service and as a law enforcement lawyer, serving the citizens of New York, is well within the mainstream.

Today’s vote continues the Republican pattern of obstruction. My judicial nominees wait more than three times as long on the Senate floor to receive a vote than my predecessor’s nominees. The effects of this obstruction take the heaviest toll on the D.C. Circuit, considered the Nation’s second-highest court, which now has only seven active judges and four vacancies. Until last month, for more than forty years, the court has always had at least eight active judges and as many as twelve. A majority of the Senate agrees that Ms. Halligan is exactly the kind of person who should serve on this court, and I urge Senate Republicans to allow the Senate to express its will and to confirm Ms. Halligan without further delay.

Pioneer ACOs Threaten To Walk

The Pioneer accountable care organizations have asked the Center for Medicare and Medicaid Innovation to revise quality benchmarks the ACOs have to meet to qualify for Medicare bonuses, threatening to drop out of the program otherwise.

The Pioneer ACOs note 19 of 31 quality measures were set without anchoring methodology, reflecting a lack of data, according to a letter sent Feb. 25 and posted online by The Washington Post. The Pioneer and Medicare Shared Service Program ACOs suggest they can provide data to better inform the selection of empirical benchmarks.

The Pioneer ACOs also suggest some proposed benchmarks are too high, including those based on data from Medicare Advantage. "We believe there are fundamental differences between the experience of non-managed and managed populations that warrant consideration when establishing pay-related benchmarks," they wrote.

They "strongly recommend" Pioneer ACOs remain in reporting-only status for performance year 2013 so benchmarks can be rebuilt for 2014 performance. They requested a decision before April 2.

The letter was first reported by Inside Health Policy, which noted Wednesday that CMS Acting Administrator Marilyn Tavenner said she will meet this month with the Pioneer ACOs to discuss their demands.

"We all feel like we're pioneering an effort to convert our health care system from purely volume-based to a more value-based approach," Jim Hinton, CEO of Presbyterian Health Services in New Mexico, one of the Pioneer ACOs, told The Washington Post's Health Reform Watch blog. "So like any programs of a new size, there have been some start up and transition issues."

For Immediate Release March 08, 2013 Fact Sheet: Implementation of Export Control Reform

Today, the Administration announced two key steps to further the goals of President Obama’s Export Control Reform Initiative, which is a common sense approach to overhauling the nation’s export control system. President Obama signed an Executive Order today to update delegated presidential authorities over the administration of certain export and import controls under the Arms Export Control Act of 1976, and yesterday the Administration notified Congress of the first in a series of changes to the U.S. Munitions List.

Executive Order

Executive Order 11958 delegated authority to control exports of defense articles and services to the Secretary of State and delegated the comparable authority to control imports to the Secretary of the Treasury. The Department of State controls the export of defense articles and services on its U.S. Munitions List (USML); the Department of Justice controls their import pursuant to the U.S. Munitions Import List (USMIL) administered by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). The USMIL was previously a subset of State’s USML. The most recent comprehensive delegation of these authorities was in Executive Order 11958 of January 18, 1977. The President’s new Executive Order updates delegated authorities consistent with the upcoming changes to our export control lists. It supersedes and replaces Executive Order 11958 and amends Executive Order 13222 of August 17, 2001, that pertains to the Department of Commerce-administered controls. The new Executive Order makes the following changes:

Consolidation of All Brokering Responsibilities with the Department of State: The Arms Export Control Act requires the registration and licensing of brokering activities for defense articles and services for both exports and imports. A broker is a person who acts as an agent for others in negotiating or arranging contracts, purchases, sales or transfers of defense articles or services. The Executive Order consolidates and delegates to the Secretary of State all statutory responsibility for maintaining registration and licensing requirements for brokering of defense articles and services on either the State or ATF lists which both control defense articles and services under the Arms Export Control Act. This one-stop approach provides better clarity for the defense trade community and makes it easier for industry to comply and for the U.S. Government to enforce.

Elimination of Possible “Double Licensing” Requirements: Today the Department of State licenses entire systems, including any accompanying spare parts, accessories, and attachments, yet many of these items will be moved to the Commerce list which may mean that an exporter would need two licenses instead of one. The President’s delegation, via an amendment to Executive Order 13222, will allow the Department of State to authorize those accompanying items that may have moved to the Commerce list and prevent any potential double-licensing requirement. This ensures that the prioritization of our controls, in which we facilitate secure trade with Allies and partners, does not add new red tape. Items licensed or otherwise approved by the Secretary of State under this delegation remain subject to the jurisdiction of the Department of Commerce, including for enforcement purposes.

Congressional Notification Process: The President has directed that the Department of Commerce establish procedures for notifying Congress of approved export licenses for a certain subset of items that are moved or that may move from the State list to the Commerce list. A key feature of the President’s reform initiative is to enhance transparency with Congress and the public in the administration of our export control system. This Executive Order ensures that, going forward, the Executive Branch will continue this transparency and notify Congress about export licenses for those certain items that, while no longer subject to the statutory notification requirements of the Arms Export Control Act, warrant continued transparency and notification to Congress.

Other Administrative Updates: The Executive Order delegates to the Attorney General the functions previously assigned by Executive Order 11958 to the Secretary of the Treasury, reflecting the 2003 move of ATF to the Department of Justice from the Treasury (accommodated by Executive Order 13284). It also makes a number of other necessary updates to ensure that the authorities to administer our export control system are current.

Changes to the U.S. Munitions List

The cornerstone of the President’s Export Control Reform Initiative is the rebuilding of the two primary export controls lists, State’s USML and the Department of Commerce’s Commerce Control List (CCL) which primarily controls dual-use items, i.e., commercial items with possible military applications, and some military items of lesser sensitivity. By law, everything on the USML is controlled equally, whether an F-18 fighter or a bolt that has been modified for use on that F-18, and each of these items requires an individual license. This system has created significant obstacles and delays in providing equipment to Allies and partners for interoperability with U.S. forces in places like Afghanistan, and harms the health and competitiveness of the U.S. industrial base. Rebuilding our export control lists and moving less sensitive items from the State to the Commerce list will provide us the flexibility to more efficiently equip and maintain our partner’s capabilities while allowing us to focus on preventing potential adversaries from acquiring military items that they could use against us.

The Administration notified Congress yesterday of the first in a series of changes to the USML, as required by Section 38(f) of the Arms Export Control Act. Once the Congressional notification period concludes, these changes -- to current Department of State- administered controls on Aircraft and Gas Turbine Engines -- will be published, with an effective date of 180 days after publication. The revised USML will enable the United States to better focus its resources on items that deserve the highest levels of export protection and on destinations of concern, while providing American companies with a streamlined export authorization process for thousands of parts and components. The remaining USML changes will be published on a rolling basis throughout 2013, and ultimately will update every category of defense articles to better meet current national security and economic challenges. These actions will improve our national security by better utilizing our export licensing and enforcement resources to focus on those items, destinations, and end-uses of greatest concern, improve interoperability with Allies and partners, and bolster the U.S. defense industrial base. American Epidemic: Rise In Diabetes Rate Is The ‘Main Driver’ Of Increased U.S. Medical Costs

The reality of America’s obesity and diabetes epidemics and their resulting effects on national health care costs have been well-established — and on Thursday, a new report revealed that the public health crisis has gotten even worse in the last decade.

According to the report by the American Diabetes Association (ADA), direct and indirect health care costs associated with diabetes rose from $174 billion in 2007 to $245 billion in 2012 — an increase of 41 percent over 5 years. Only a little bit of that can be attributable to general medical inflation, which has actually been slowing down in the last couple of years. The sheer scope of the increase indicates that more and more Americans are falling prey to the disease — and it’s taking a clear toll on U.S. health care spending:

“As the number of people with diabetes grows, so does the economic burden it places on this country,” [said ADA's Chief Scientific & Medical Officer, Robert Ratner, in a statement.]
The study finds that medical expenditure for people with diabetes is about 2.3 times higher than for people who don’t have the disease and that the main driver of the increased overall financial burden on the country is the rise in proportion of the population that has the disease.
“The cost of diabetes is rising at a rate higher than overall medical costs with more than one in 10 health care dollars in the country being spent directly on diabetes and its complications, and more than one in five health care dollars in the US going to the care of people with diagnosed diabetes,” says Ratner.

Diabetes and obesity-related illnesses tend to disproportionately affect populations that are also on government-subsidized health programs — especially low-income Americans — and made up anywhere between 10 and 12 percent of all health insurance spending back in 2006. Considering the new report’s findings, that number has probably ballooned further. The study found that 64 percent of diabetes-related care, specifically, was funded by Medicare, Medicaid, and military health care programs.

Hospital Wellness Program Didn't Lower Costs

Wellness programs do not appear to lower overall healthcare costs, a new study shows, leading researchers to conclude the Affordable Care Act's wellness program incentives won't significantly reduce healthcare spending.

The study, published Monday in the journal Health Affairs, looked at a wellness program launched in 2005 by the St. Louis-based BJC Healthcare hospital system, which required employees wanting access to the system's most generous health plan to participate in the program.

To participate in the company's "Gold" health insurance plan, employees had to complete a web-based health risk assessment including blood pressure, serum glucose, height, weight, cholesterol readings and waist circumference. They also had to sign a pledge promising to eat healthy food and exercise regularly, and enroll in a smoking cessation program if they smoked.

The hospital system, for its part, held health fairs that provided physician referrals. Moreover, employees participating in the wellness program received discounted premiums in addition to access to the most generous plan.

While hospitalizations for conditions targeted by the program fell 41 percent compared with a nonparticipating employee group, the health system saw no significant decrease in other hospitalizations, according to the study. At the same time, inpatient costs fell as other expenses increased.

The result: BJC Healthcare did not save money, at least not in the short term.

In addition to raising questions about the cost-saving assumptions of the Affordable Care Act, the findings come at a time when more and more hospitals are offering employee wellness programs. The belief has been that wellness programs drive down healthcare costs.

Cruz: Spending Bill Must Defund Obama Healthcare Law

Sen. Ted Cruz (R-Texas) said Wednesday that he will object to a government spending bill if it does not cut off funds for President Obama's signature healthcare law.

Cruz, a staunchly conservative freshman, said he will offer an amendment to delay the flow of funds to implement the healthcare law when the Senate takes up a continuing resolution to fund the federal government.

"I believe we should continue to delay such funding at least until economic growth returns to historic averages, and I intend to object to consideration of any Continuing Resolution that does not include a vote to delay funding of Obamacare," Cruz said in a statement.

Cruz has already ruffled some feathers within the GOP with his acerbic style. And by demanding a provision to defund the healthcare law, he would be picking a fight that most of his Republican colleagues don't seem eager to wage.

House Republicans' continuing resolution does not propose defunding the healthcare law, even though the House has voted more than 30 times to repeal or defund parts of the law.

Some Republicans have tossed around the idea of delaying the healthcare law as a way to save money — its most expensive provision, new subsidies to help people buy private insurance — kicks in next year.

But even conservative Republican lawmakers have acknowledged that proposal wouldn't get any traction in the Democratic-controlled Senate and said it might not be a political battle worth waging.

Cruz, though, said the Affordable Care Act will stifle economic growth.

"In my view, Obamacare should be fully repealed, and I have introduced legislation to do so," he said. "At a minimum, however, it should not be implemented at time when our economy is struggling so mightily, at a time when its implementation could push us into a full recession."

The National Strategy for Global Supply Chain Security, released in January 2012, established the U.S. Government’s policy to strengthen the global supply chain to protect the interests of the American people and enhance our Nation’s economic prosperity.

The Administration, in coordination with private sector stakeholders and foreign government partners, made significant progress in implementing the Strategy throughout 2012 and in defining our priorities for future work. As required by the Strategy, Federal Departments and Agencies prepared a consolidated report outlining these efforts and defining 2013 implementation goals. Royalty Pharma says ready to move quickly on Elan offer

March 6 (Reuters) - U.S. investment firm Royalty Pharma

stood by its offer on Wednesday to acquire Irish drugmaker Elan , which has rejected the approach, saying it was ready to move quickly and that it could complete due diligence in 20 days.

It also said it was meeting with Elan shareholders.

Royalty Pharma made a $6.6 billion approach last week after Elan announced last month a $3.2 billion plan to sell its 50 percent stake in multiple sclerosis drug Tysabri to its U.S. partner Biogen Idec .

Elan rejected Royalty Pharma and on Monday sweetened its offer to shareholders, saying that it would give them 20 percent of future royalties from the drug. It had already planned to return $1 billion to shareholders after the drug sale.

Joss Whedon’s ‘Much Ado About Nothing,’ Slut-Shaming, And Hero And Claudio’s Story

I’m hoping to catch Joss Whedon’s Much Ado About Nothing at South By Southwest, though it looks like scheduling may not allow for it. But looking at the trailer, I’ve got two thoughts:

First, I love me some Alexis Denisof and Amy Acker, but I think it’s going to be hard for me to see them not in the context of Kenneth Branagh and Emma Thompson’s performances in those roles in from twenty years ago. Acker’s so good at retiring roles that it’s hard for me to really imagine her with a delightfully poisonous tongue.

And second, I’m curious as to how the adaptation is going to handle Hero and Claudio, played respectively by Jillian Morgese and Fran Kranz. Their story, in which Hero’s chastity is called into question, the wedding between the young lovers is called off, and Claudio is made to feel guilty by being told that Hero’s literally died of grief is a much harder thing to bring into the moder era than a clash of wits between a much more contemporary couple like Beatrice and Benedick. There’s very interesting stuff to be done with Hero and Claudio about anxiety about relative sexual experience, slut-shaming, and the anxiety of marriage. But getting there and doing it right in this setting probably means jettisoning the set-up in which Claudio believes that Hero is dead. I’m curious to see how Whedon will work it all out. Giving us modern screwball with Beatrice and Benedick is awfully fun, but it’s the easy lift here. Transforming Hero and Claudio and doing it well will be the much more impressive feat.
