Congress Is Strong-Arming The Postal Service Into Bankruptcy Even Faster

On Thursday, Congress voted against allowing the U.S. Postal Service to cut its delivery down to five days a week, forcing the organization to keep delivering mail on Saturdays. This will drive the USPS into looming bankruptcy — already foisted upon the USPS by Congress itself — even faster.

In 2006, Congress passed the Postal Accountability and Enhancement Act, mandating that the USPS front the money for 75 years of employee pensions — a requirement no other public or private institution faces.

In trying to scrape up money for the pensions of kids who haven’t even graduated high school yet, the USPS has spiraled into near-bankruptcy. Without the pension requirement, a July 2012 analysis showed, the USPS would have a $1.5 billion surplus. Instead, it’s billions of dollars in the red.

Dropping Saturday delivery was supposed to be its way of trying to fight these congressionally-imposed deficits. But yesterday, Congress rejected the five-day proposal, roundly agreeing that the USPS must keep its service at six days a week, even though it can hardly afford to do so.

Now, the USPS is looking for a workaround to see if it can cut back on first-class mail, magazine, and direct mail delivery while still meeting Congress’s six-day mandate.

Though the Postal Service is an independent agency, a legal opinion by the Government Accountability Office found that it needs Congressional approval to change its budget or delivery schedule.

Congress has apparently not considered that postal access matters, particularly to rural Americans. Members of Congress seem content to let the USPS flounder, despite the fact that it would take just one simple step to fix the USPS’s budget problems: repealing the pension requirement. It doesn’t look like Congress will let that happen any time soon.

GOP Hijacks Budget Process To Dismantle Obamacare

The Senate plans to begin considering the Democratic-sponsored budget resolution on Friday or Saturday, including the slew of amendments that Republican senators have tacked onto the legislation. Since budget amendments only need a simple majority to pass, GOP lawmakers have seized the opportunity to push their agenda by rushing to file hundreds of them — including several that would dismantle Obamacare.

Here are just some of the amendments that seek to undermine the implementation of the law, just as advocates prepare to celebrate its third anniversary:

REPEAL OBAMACARE: Tea Party favorite Sen. Ted Cruz (R-TX) cuts to the chase with Amendment #202, which would “establish a deficit-neutral reserve fund to provide for the repeal of the Patient Protection and Affordable Care Act and the Health Care and Education Reconciliation Act of 2010.”

PREVENT ANY NEW OBAMACARE SPENDING: Amendment #285, introduced by Sen. Robert Wicker (R-MS), wouldn’t repeal the health law outright — but it would “provide for the repeal of new spending under the Patient Protection and Affordable Care Act.”

REPEAL OBAMACARE’S FUNDING SOURCES: Several amendments seek to undermine Obamacare by preventing it from being able to use new revenue to carry out its health reform provisions. Sen. Mike Crapo (R-ID)’s Amendment #222 would “repeal the tax increases enacted under the Patient Protection and Affordable Care Act that were imposed on low- and middle-income Americans,” and Sen. Dan Coats (R-ID)’s Amendment #194 would “repeal the 3.8 percent tax on investment income imposed by the Patient Protection and Affordable Care Act.”

DELAY OBAMACARE’S IMPLEMENTATION: The health reform law’s implementation is marching forward across the country, but Sen. Richard Burr (R-NC) wants to halt that progress. His Amendment #357 seeks to “delay implementation of the President’s health care law for 2 years.”

INHIBIT MEDICAID EXPANSION: Sen. Tom Coburn (R-OK)’s Amendment #408 would “reduce the federal matching rate for Medicaid expansions,” which could threaten funding for the provision and dissuade states from opting to expand their Medicaid pools. Even though federal funding for Obamacare’s optional Medicaid expansion is not currently in question, Coburn also wants to “prevent the federal government from making an unrealistic promise to States to fund any State’s expansion of the Medicaid program at a higher level of federal reimbursement.”

ELIMINATE HEALTH INSURANCE SUBSIDIES: Two different amendments — #326 from Sen. Lindsay Graham (R-SC) and #417 from Sen. Coburn — seek to eliminate some of the subsidies that help ensure Americans can afford to purchase health care on the state-wide insurance marketplaces. Obamacare allows Americans with incomes up to 400 percent of the federal poverty level to receive some assistance to buy health insurance, but Graham and Coburn want to lower that cut-off to 300 percent.

UNDERMINE PUBLIC EDUCATION ABOUT HEALTH REFORM: Many Americans still have significant misperceptions about what’s included in Obamacare, but Sen. Pat Roberts (R-KS) doesn’t want those to be cleared up anytime soon. Roberts introduced Amendment #187 to “prohibit the use of funds for promotional or marketing materials promoting the Patient Protection and Affordable Care Act.”

Republicans have tried to repeal all or parts of the Affordable Care Act at least 54 times since its enactment.

President Obama Nominates Two to Serve on the U.S. Court of Federal Claims

Patricia E. Campbell-Smith:  Nominee for the United States Court of Federal Claims

Patricia E. Campbell-Smith has served as a Special Master with the United States Court of Federal Claims since 2005 and as Chief Special Master since 2011.  In that role, she presides over litigation pursuant to the National Vaccine Injury Compensation Program.  Previously, Campbell-Smith served as a career law clerk for the Honorable Emily C. Hewitt of the United States Court of Federal Claims for seven years.  From 1993 to 1996 and again from 1997 to 1998, she worked at the law firm of Liskow & Lewis in New Orleans, where she focused on environmental regulatory law, patent infringement litigation, and toxic tort litigation.  From 1996 to 1997, she served as a law clerk for the Honorable Sarah S. Vance, and from 1992 to 1993 she served as a law clerk for the Honorable Martin L.C. Feldman, both of the United States District Court for the Eastern District of Louisiana.  Campbell-Smith received her J.D. with honors in 1992 from Tulane Law School and her B.S. with honors in 1987 from Duke University.

Elaine D. Kaplan serves as General Counsel of the United States Office of Personnel Management, a position she has held since 2009.  Previously, she was Senior Deputy General Counsel at the National Treasury Employees Union (NTEU) from 2004 to 2009 and Of Counsel at the law firm of Bernabei and Katz from 2003 to 2004.  In 1998, Kaplan was unanimously confirmed by the Senate to serve as the head of the United States Office of Special Counsel and successfully completed a five-year term in that position.  From 1984 to 1998, Kaplan worked at NTEU with increasing levels of responsibility.  She began her legal career as a staff attorney in the Solicitor’s Office of the United States Department of Labor.  Kaplan received her J.D. cum laude in 1979 from the Georgetown University Law Center and her B.A. in 1976 from the State University of New York at Binghamton.

CVS to Workers: Tell Us What You Weigh or It'll Cost You

CVS Caremark has put its employees on notice that they need to reveal their weight or pay a monthly $50 penalty.

"Avoid the $600 annual surcharge," CVS warns its employees who use the company's health insurance plan. They've been told they are required by May 1 to show up to a doctor for an annual WebMD Wellness Review and submit to tests for blood sugar, blood pressure, cholesterol and body mass and body weight.

"Going forward, you'll be expected not just to know your numbers - but also to take action to manage them," the CVS policy states.

While many employers have been pushing its workers to get healthier, it's usually through incentives rather than penalties. "This is about as coercive and blunt as I've ever seen," said Dr. Deborah C. Peel, the founder of Patient Privacy Rights, a nonprofit organization based in Austin, Texas.

"Many employers want to do something for their workers, but very few of them are stupid enough to say give us the information and sign this form and say it's voluntary," Peel said.

Smokers working for CVS are also warned: "You must either be tobacco-free by May 1, 2014, or participate in the WebMD tobacco cessation program." Defiant smokers can avoid penalties if they are healthy enough in other categories specified by the company.

Despite the company's promises, Peel worries if CVS and WebMD will be able to keep the employee records completely private. Peel said people are already declining to get health treatment for issues ranging from psychiatry to sexual diseases, for fear the information will not be kept private.

In a statement, CVS said the employee health data will be kept private and it defended its new policy. CVS, which is based in Rhode Island, also said the company would never see the test results.

"The use of health screenings by employer-sponsored health plans is a common practice. According to a National Business Group on Health survey, 79 percent of employers offered a health assessment in 2011 and 76 percent of those employers offered incentives for completion. Also, 62 percent of large employers offered biometric screenings and 52 percent of those employers offered incentives for completion),' the CVS statement reads in part.

"CVS Caremark is committed to providing medical coverage and health care programs for our colleagues and our benefits program is evolving to help our colleagues engage more actively to improve their health and manage health-associated costs. An initial step to accomplish this goal is a health screening and wellness review so that colleagues know their key health metrics in order to take action to improve their overall health, if necessary."

WebMD did not immediately respond to a request to comment on its program.

I think that religion is just a tool to make people feel safe and not alone in this world. However, many religious doctrines have been proven wrong by modern science. In the case of Christianity, science has disproved the biblical teaching that the world is flat. Science has shown us that the world cannot be 6,000 years old as the bible teaches through methods such as carbon dating with fossils. So now that we know how most of the world works there is no need for it anymore. I mean the world isnt flat right and we know the world isnt 6000 years old. So basically in this day in age we dont need an ancient book to tell us how the world works. i would like to think of myself as more intelligant then people who were alive 2000 years ago. All major religions (with the exception of buddhism which does not worship a higher being) were created to outline specific mores and give simple comprehendable explanations for things as complex as the creation of the universe. In today's world, religion can really only serve one of those two purposes effectively, that is to provide moral codes and societal rules. An ever increasing amount of "history" provided in the Bible has been proven to be false, and it seems unlikely that the entire universe was created by a being living in the third dimension and shaped like a human being (it also seems like an egocentrical thing to believe but that's beside the point). So religion's only real significant purpose today is to set up moral code. However, this is not to say that laws should be based on such moral codes. The moralities set up in each religion are different. Mores are not universally accepted or shared. Furthermore, many rules set up in the bible cause the infringement upon the rights of others (i.e. banning of gay marriage, bans on abortion etc.). Religion has to be relevant in that so many people are influenced by it. Religion is not relevant in discovering scientific truth and has only served to impede scientific understanding. Religious truth is necessarily contradictory to factual understanding as the particular notion of truth only becomes the purview of religion is unsubstantiated or contradictory to physical or natural truth otherwise it is a general truth. Therefore the focus of conservipedia is the aspects of Christianity that focus on the discrepancies between reason and logic based on observable, quantifiable, understandable phenomenon and an interpretation of Christian text biased towards the Conservative Agenda.

So many inaccuracies and assumptions in your statement that I can't address them all without turning what should be a forum into a dialogue. Anyway, if by religion you mean faith in God and reacting to your faith in a manner similar to many others, then yes, it is of critical and eternally lasting importance. If you mean the highly ritualized practices of organized religion such as in Roman Catholic or Anglican services, then I would say it's less important, as the decline of "religion" in Western Europe over the last 50 years has shown. --Daniel B. I'd say that Religion has always been relevant (or important or destructive) or whatever you choose to say. In my own view, Religion has been, by far, the Most destructive of all weapons of mass destruction. Arguing that the killings of humans by other humans in the name of religion is by a few zealots/crazies is missing the point. Today, we look at the extremists of the Islamic world with horror, a few centuries ago, it was the Christians slaughtering the non-believers in the Crusades. I do not believe that any part of the world, any religion has been insulated from the killings in the name of THAT religion. To dismiss this as the acts of a few, to grab power/money or whatever is not sufficient. We ought to examine why men have historically used religion as a weapon and not as they claim it is supposed to be used - show the path to eternal truths using persuasion and words and not the sword.

Of course religion is and was relevant what does not mean that it should be relevant. Most people in the world believe in a religion. And many live their religion. They arrange their day arround religious habits. Not working on Friday or Sunday. No meat, no pork, no alcohol, limited sexuality, ... there are many restrictions that restrict people in their life and in the way they behave in socciety. Fanatic religious people as well as people who pretend to be (fanatic) religious to gain more power for worldly plans are one of the biggest threats today. In that point it does not matter WHAT religion one has. If a person is holding some written or told words for true in every case without using the own brain, it leads often to murder and hatered. As allready mentioned in statement above mine, there was slaughtering in many religions including christianity. The church was there when the native americans were slaughtered. The church was there when "whiches" were burned. The church was there, when the Nazis took Jews to concentration camps. And today the christian church es in Germany still receive the taxes that were introduced by Hitler. (What means they are possibly the only institution still profiting from WW2) But that does not mean that the catholic church or even religions in total are evil? I would say NO! They are not evil. But many people, who are religious are evil. And for those it is easy to find credulous believers. For sure religion is relevant. A widely published author once wrote something like this: When religion fails to inculcate a sense of morality into society then the whole of law and enforcement falls onto the shoulders of government. In broad, general terms, religion is a force for morality, for good. Though not every religion has 10 commandments exactly, traditional religions have a moral code its followers are encouraged to follow. I would have to disagree with both you and that author. In a Canadian city, about 40 years ago, the police went on strike for a day. Shops and banks were robbed, cars stolen, vandalism, looting etc. The town pretty much went to the dogs for that day, and almost every shop along the main drag was robbed and massive amounts of damage occured. Now, the majority of the people in that city were christians, and fairly devout ones as well, yet despite having a "strong moral code" they still participated in the robberies and muggings because the police weren't there. This suggests that faith in God is not enough to stop people doing bad things, a lot of people need something more mundane and real. Bolly Ottihw 09:30, 22 April 2007

Religion is not relevant in todays society because Truth is absolute and not relative. Religion is a concept created to make false belief systems seem the same as the one true beleif system that the one true God allowed his only son to die for our sins.

Religion? No, lets make this quite clear: Not all religions are equal. Christianity should play a large role in modern society, as God intended, for it is the Truth. But the abomination of Islam should be wiped out, destroyed by force if nessicessary - both for its constantly earthly attrocities and oppressions, and for leading people from Christ and thus damning them eternally. To speak of 'religion' lumps all religions together. Riiiigghhttt... it was only 1998 when the Catholic Church announced that the world was not in fact, flat. Furthermore, Christian beliefs like the Earth being 6,000 years old have been long abandoned by most Christians after nearly irrefutable scientific evidence to the contrary. As for believing the Earth is the center of the universe, those following an entirely literal interpretation of the Bible still follow this belief.

And, being flexible is a good thing. Science changes constantly because more and more evidence is found and more and more research is done. As these changes continue, as new information is discovered, scientific thought begins to move further and further from the history told in the Bible. Many Christians however, hold on to what little in the Bible hasnt been unquestionably proven inaccurate claiming the Bible as absolutely true. Science advances, Christianity is still living in the Dark Ages.

Minor correction - in 1998, the Catholic Church did not admit the world was not flat. They never claimed that in the first place, it was a story made up to poke fun at them shortly after the continent of America was (re-)discovered. An easy mistake though - 1998 is the year in which they admitted that the earth is not the stationary center of the universe, and that not everything has to orbit around it. The RCC always knew the earth to be round, and even had a good idea of its size - both discoveries of Greek science. They did have some minor doctrine on the issue though: Church policy was that the other side of the earth was nothing but uninhabitable water, an assumption based on the idea that if there were another continent then they could not be exposed to the Second Coming of Christ, which the bible states will be witnessed by all people. - BornAgainBrit

I think that to say that is in blatant ignorance of the facts of many atrocities commited in the name of the christian God and with the support of the church. There are good morale people and there are bad inmorale people. There are good religous people and there are bad religous people. Religion does not make you a better or more morale person. Sometimes people use religion as guidlines or something that can scare them into doing the right thing. Ever wonder why it is that human life was short and miserable prior to the enlightenment, while since the enlightenment, average human quality of life has been improved exponentially? Ever wonder how every remarkable improvement of individuals and society happened in spite of religious dogma? If religion had had its way, without he input of science and humanism, we would still be in a world where life expectancy is in the 20s, a small cut is a death sentence via infection, and people who criticize religion, like me, would be burned at the stake. Religion has had thousands of years to attempt to prove itself necessary, something that it has failed at miserably every time. Also, for those who posit that Christianity is necessary, but none of the others are, ask yourself: would I rather be alive today, or in the 15th century? =skb

This seems to be a pointless question. Which religion are you refering to? Do you mean one in particular or just religiosity in general? If you say yes or no how far are you willing to go to bring about that outcome?

Right...because we know that this so called God said that Christianity was right and was the truth...Hey, why don't we all live like our savior Jesus...oh wait, Jesus was Jewish...If you want to follow his path, convert! Also, I have trouble taking arguments seriously when I read:

There is no proof whatsoever of the existence of a supreme being. Not one single bit of information. There are approximately 6 billion people in this world, and if I'm not mistaken, over 80% of people are religious...That means 4-5 billion people waste their time praying to nothing (Assuming all of these people have prayed at some point or another)

What makes you believe in God? Somebody told you that God existed as a little child and you believed them. People also used to think that cigarettes weren't harmful to the body, but guess what, people were wrong!

Take a moment and think...what has God done for me? How would my life be different if I did not believe in God?

I have no answer, but then again, I'm atheist.

Lack of evidence does not speak against the truth/existence of anything, anybody with a basic knowledge of science should know that. And religion gives you a crutch, regardless of whether it is true or not; knowing (truly believing, knowing that you are undoubtedly correct) that there is a God who loves you can be the best drug ever. That isn't true. I believe reality exists. The truth is out there and then it whops us on the head. Damn truth. I was under the impression that religion had to do with belief in God(s). Not that it's not relevant, its just, it shouldn't play a large role. Relgion is like your thoughts, its yours, you make it according to your own personal moral values and based on the teachings of those before you. Getting religions entangled with people is quite dangerous some times, or annoying at others. Religion is for you and those who believe with you and those who wish to believe, none others.

Clean Energy Trends: The Future Is All About Deployment

2012 proved to be an unsettling and difficult year for clean energy. High-profile bankruptcies and layoffs plagued many clean-tech companies, overall venture investments retreated in the face of increasingly elusive returns, and the industry was begrudgingly transformed into a partisan wedge issue during the U.S. presidential campaign.

But as we highlight in our just-released Clean Energy Trends 2013 report, the fundamental global market drivers for clean technology remain largely intact. Intensifying resource constraints loom large. Unprecedented climate disruption in the U.S. and abroad is putting resiliency and adaptation front and center. And President Obama has signaled a strong commitment to expanding clean energy and energy efficiency in his second term, calling for another doubling of renewable power by 2020. Similar commitments exist in China, Japan, and the European Union.

The report found that lower prices for many clean-tech goods and services, combined with a renewed focus on scalable projects, resulted once again in record annual solar, wind, and biofuels deployment. Against this continued expansion, however, combined global revenue for solar PV, wind power, and biofuels expanded just one percent, from $246.1 billion in 2011 to $248.7 billion in 2012. This marginal growth was one of the many consequences of rapidly declining solar PV prices.

Some of the report’s key findings include:

Biofuels (global production and wholesale pricing of ethanol and biodiesel) reached $95 billion in 2012, up from $83 billion the previous year. From 2011 to 2012, global biofuels production expanded from 27.9 billion gallons to 31.4 billion gallons of ethanol and biodiesel.Wind power (new installation capital costs) expanded to $73.7 billion in 2012, up from $71.5 billion the previous year. Global wind capacity additions totaled 44.7 GW (gigawatts) in 2012, a record year led by more than 13 GW added in both China and the U.S., and an additional 12.4 GW of new capacity in Europe.Solar photovoltaics (including modules, system components, and installation) decreased from a record $91.6 billion in 2011 to $79.7 billion in 2012 as continued growth in annual capacity additions was not enough to offset falling PV prices. While total market revenues fell 19 percent — the first PV market contraction in Clean Energy Trends’ 12-year history – global installations expanded to a record of 30.9 GW in 2012, up from 29.6 GW the prior year.Together, we project these three sectors will continue to grow over the next decade, nearly doubling from $248.7 billion in 2012 to $426.1 billion in 2022.

In many ways the shift to cleaner sources couldn’t be clearer. Renewables and natural gas made up more than 80 percent of new electricity capacity additions in the U.S. in 2012, with renewables coming in at 49 percent and natural gas at 33 percent. For the European Union, the renewables number is even higher, with solar in the driver’s seat. In 2012, newly installed solar PV accounted for 37 percent of all added capacity, followed by wind with a 26.5 percent share, and gas at 23 percent. In total, renewable sources represented more than 31 GW of the 44.6 GW of new generation capacity in the EU, roughly 70 percent of all new capacity for the second consecutive year.

Generating capacity is, of course, not the same as actual generation. But even in this regard, clean energy sources have moved past their days as rounding errors and are playing a significant role in meeting electricity demand in a number of global markets. Wind energy in Denmark blew past a 30 percent share of national electricity use in 2012, and an official target is in place to generate half of the nation’s power from wind by 2020. In Germany, clean energy already accounts for 25 percent of energy production — led by wind (9.2 percent), biomass (5.7 percent), and solar (5.3 percent) — and the country is aiming for 35 percent from renewables by 2020.

Clean energy continues to expand as a major economic force, with an increasing focus on deployment of readily available technologies.

In early 2013, for example, Warren Buffett’s MidAmerican Energy Holdings expanded its solar portfolio with a whopping $2 billion acquisition of the Antelope Valley Solar Projects in Southern California, one of the largest utility-scale solar developments in the world. (Buffett’s investment in the Antelope projects came with long-term purchase agreements already lined up with Southern California Edison.) Google’s recent $200 million equity investment in a Texas wind farm pushed the tech giant’s ownership in solar and wind projects to a combined 2 GW, making it one of the largest renewable energy asset owners. And in January, car rental giant Avis Budget Group announced its plan to buy car-sharing pioneer ZipCar for $500 million, a promising reminder that new ways of thinking can be just as disruptive as new technologies.

What all this seems to point to is something we’ve talked about for years: the scale-up of clean-tech deployment. And it’s not just the big investors shifting their focus toward deployment. Mosaic, which we highlight in this year’s Trends report, is bringing solar deployment investment opportunities to small investors via a crowdfunding platform, offering annual yields of around 4 to 5 percent. And don’t forget the state-level Green Banks established in Connecticut and announced in places like New York and Hawaii or the prospects for new project deployment tools like real estate investment trusts (REITs) or master limited partnerships (MLPs).

Indeed, the near- to mid-term will be all about getting assets in the ground. That is where the action will be. It will take many shapes and sizes, from large corporate investments to crowdfunding and will span the globe from the U.S. to Japan.

This new focus on deployable and proven technologies reflects the maturation of an industry that was a mere blip on the economic radar just a decade ago, but today represents the largest slice of new electricity capacity additions in the U.S. and European Union. Even in pro-nuclear China, wind overtook the atom as a generator of electricity in that nation’s power mix in 2012. To ensure that clean energy keeps up its momentum, however, we’ll need new models and a leveling of the playing field — and that will take hard work, creativity, and, in the face of entrenched interests, a great deal of steadfast commitment and endurance.

One Day After RNC Calls For Minority Outreach, Arkansas GOP Passes Bill To Suppress Minority Vote


Monday morning, the Republican National Committee released a lengthy “autopsy” of their 2012 electoral loss, much of which was devoted to the GOP’s weak standing among people of color. “It is imperative that the RNC changes how it engages with Hispanic communities to welcome in new members of our Party” the autopsy proclaims, and “the Republican Party must be committed to building a lasting relationship within the African American community year-round, based on mutual respect and with a spirit of caring.”

One day later, Arkansas Republicans showed their mutual respect and spirit of caring for people of color by passing a law that will keep many of them from casting a vote.

Yesterday, the Arkansas Senate passed — on an entirely party-line vote — a so-called voter ID law requiring voters to show photo identification before they can cast a ballot. The same voter suppression measure already passed the state House with all but one of the votes for the bill coming from Republicans. These laws, which are popular among Republican lawmakers, accomplish little more than disenfranchisement. Even conservative estimates suggest that these laws will prevent 2 to 3 percent of registered voters from casting a ballot. And this impact is felt hardest by low-income voters, students and people of color — all of who tend to prefer Democrats to Republicans.

The most common argument raised in favor of voter ID laws is that they prevent in-person voter fraud, but this claim cannot be squared with reality. A person is more likely to be struck by lightning than to commit fraud at the polls. A Wisconsin study found that only 0.00023 percent of votes are the product of such fraud. So voter ID laws disenfranchise a large chunk of voters — between 2 and 9 percent, according to different reports on their effect — in order to prevent a virtually non-existent form of voter fraud.

The bill will now go to Gov. Mike Beebe (D-AR), who should veto it.

Today we welcomed her to the White House to meet with White House staff, including Special Assistant to the President and Senior Director for Western Hemisphere Affairs Ricardo Zuniga, to discuss her efforts to promote increased respect for freedom of expression in Cuba.  The United States looks forward to the day when all Cubans will have the opportunity to express themselves in public without fear and we will continue to support policies that encourage the free flow of information to, from, and within Cuba.
